1. Acceptance of these Terms
By downloading, installing, or using Lemonade (“the App”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. The service
Lemonade is a client application for the Lemmy federated social network. It lets you connect to compatible Lemmy instances to browse feeds, communities, posts, comments, profiles, messages, and related features exposed by those instances’ APIs.
- Lemonade does not operate Lemmy servers and is not affiliated with every instance you may visit.
- Availability of features depends on the instance software version, federation status, network conditions, and your account permissions.
- We may update, change, or discontinue features of the App at any time.
3. Eligibility
You must be at least 13 years old (or the minimum digital consent age in your jurisdiction) to use the App. If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Accounts & instances
- You may use Lemonade as a guest (where supported) or by logging into one or more Lemmy accounts on instances you choose.
- You are responsible for maintaining the confidentiality of your credentials and for activity under your accounts.
- Each Lemmy instance has its own rules, moderation policies, and terms. You must comply with those rules in addition to these Terms.
- We are not responsible for bans, suspensions, content removal, or data loss on third-party instances.
5. Acceptable use
You agree not to:
- Use the App for any unlawful purpose.
- Harass, abuse, threaten, or harm others, or post illegal, hateful, or otherwise prohibited content under applicable law or instance rules.
- Attempt to gain unauthorized access to the App, other users’ accounts, or any systems or networks.
- Reverse engineer, scrape, overload, or interfere with the App or connected services except as allowed by mandatory law or open licenses applicable to third-party software.
- Misuse advertising, purchase, or entitlement systems (including fraud, chargeback abuse, or unauthorized modification of the App).
- Use the App in a way that violates Google Play, App Store, or other platform policies applicable to your use.
6. User content
Content you create or share through Lemonade is submitted to the Lemmy instance you are using and may be federated to other servers. You retain rights to your content subject to the licenses and policies of those platforms. You are solely responsible for your content and for ensuring you have the rights to post it.
We do not claim ownership of your Lemmy content. We also do not guarantee that content will remain available, unmoderated, or private once published on federated networks.
7. Advertising
The free version of Lemonade may display advertisements through third-party ad networks (such as Google AdMob). Ads may use device identifiers and related data as described in our Privacy Policy. We may offer options to disable ads in limited cases or to remove ads via a paid product.
8. Purchases & subscriptions
Lemonade may offer paid products such as remove-ads subscriptions (e.g. monthly or yearly) and/or a lifetime unlock. Purchases are processed by the applicable app store (e.g. Google Play) and may be validated using RevenueCat.
- Pricing & availability are shown in the App and/or store listing and may vary by region and change over time.
- Auto-renewing subscriptions renew unless cancelled according to the store’s procedures (manage in your Google Play or Apple ID subscription settings).
- Trials (if offered) convert to paid plans unless cancelled before the trial ends, subject to store rules.
- Restoring purchases requires the same store account used for the original purchase.
- Refunds are handled by the app store under its refund policies. Contact the store for billing disputes where applicable.
- Remove-ads products only affect advertising inside Lemonade; they do not purchase premium features on Lemmy instances themselves unless explicitly stated.
9. Intellectual property
The Lemonade name, branding, app code, design, and related materials (excluding third-party open-source components and content from Lemmy instances) are owned by the App operator or its licensors. You may not copy, modify, distribute, or create derivative works of the App except as permitted by applicable open-source licenses or with prior written permission.
Lemmy is a separate open-source project. Trademarks and branding of Lemmy, instances, Google, Apple, RevenueCat, and other third parties remain their property.
10. Third-party services & links
The App depends on third-party services, including Lemmy instances, ad networks, payment platforms, and analytics/entitlement providers. Your use of those services is subject to their terms and policies. We are not responsible for third-party outages, policy changes, content, or security practices.
11. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with every Lemmy instance, or that content obtained through the App will be accurate or reliable.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP OPERATOR AND ITS AFFILIATES, DEVELOPERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP OR ANY LEMMY INSTANCE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE APP FEATURE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the fullest extent permitted.
13. Indemnification
You agree to defend, indemnify, and hold harmless the App operator and its developers from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your content, your violation of these Terms, or your violation of any law or third-party rights.
14. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate access to App features (including paid entitlements where fraud or abuse is reasonably suspected) if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnity) will survive termination.
15. Changes to these Terms
We may modify these Terms from time to time. The “Last updated” date will be revised when changes are posted. Continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the App.
16. Governing law
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise. Courts located in Vietnam shall have exclusive jurisdiction over disputes arising from these Terms, subject to any non-waivable rights you may have as a consumer.
